Federal Court Reminds that Lawyer-Witness Rule Does Not Result in Automatic Disqualification

The “lawyer-witness” rule, RPC 3.7, disqualifies a lawyer from trial counsel if they are a necessary witness, to prevent jury confusion. A recent Seattle court case, Fisher v. Boeing, clarified that disqualification isn't automatic; the moving party must show the lawyer holds unique material evidence. Otherwise, the firm may continue in representation.

Qualification of Drivers; Exemption Applications; Epilepsy and Seizure Disorders

FMCSA announces receipt of applications from four individuals for an exemption from the prohibition in the Federal Motor Carrier Safety Regulations (FMCSRs) against persons with a clinical diagnosis of epilepsy or any other condition that is likely to cause a loss of consciousness or any loss of ability to control a commercial motor vehicle (CMV) to drive in interstate commerce. If granted, the exemptions would enable these individuals who have had one or more seizures and are taking anti-seizure medication to operate CMVs in interstate commerce.

Premiori LLC, Grant of Petition for Decision of Inconsequential Noncompliance

Premiori, LLC, (Premiori), has determined that certain Premiorri Solazo replacement passenger car tires do not fully comply with Federal Motor Vehicle Safety Standard (FMVSS) No. 139, New Pneumatic Radial Tires for Light Vehicles. Premiori filed an original noncompliance report dated June 28, 2022, and amended the report on October 27, 2022. Premiori petitioned NHTSA on July 7, 2022, for a decision that the subject noncompliance is inconsequential as it relates to motor vehicle safety. This document announces the grant of Premiori's petition.

The U.S. Consumer Product Safety Commission's (Commission or CPSC) mandatory rule, Safety Standard for Button Cell or Coin Batteries and Consumer Products Containing Such Products, incorporates by reference UL 4200A, Standard for Safety for Products Incorporating Button Batteries or Coin Cell Batteries. UL notified the Commission that it has revised this incorporated voluntary standard. CPSC seeks comment on whether the revision improves the safety of button cell or coin batteries and consumer products containing such products.
